Terms of Service

"Platform" refers to the Eterna Academy website, mobile applications, and all related services. "User" refers to any individual who accesses or uses the Platform, including Students, Instructors, and Administrators. "Student" refers to a User who enrolls in courses on the Platform. "Instructor" refers to a User who creates and publishes educational content on the Platform. "Content" refers to all materials available on the Platform, including but not limited to courses, videos, quizzes, assessments, certificates, and written materials. "Subscription" refers to a paid plan that grants access to premium features and content on the Platform.

You must be at least 17 years old or have the consent of a parent or legal guardian to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To access certain features of the Platform, you must create an account. You agree to: (a) Provide accurate, current, and complete information during registration; (b) Maintain and update your account information to keep it accurate and complete; (c) Maintain the security and confidentiality of your login credentials; (d) Accept responsibility for all activities that occur under your account; (e) Notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete.

4.1 Subscription Tiers: The Platform offers multiple subscription tiers (Explorer, Builder, and Accelerator) with varying features and pricing as described on our pricing page. 4.2 Billing: Subscriptions are billed on a monthly or annual basis as selected at the time of purchase. All prices are displayed in Indonesian Rupiah (IDR) unless otherwise stated. 4.3 Payment Processing: Payments are processed through third-party payment providers. By providing payment information, you authorize us to charge the applicable fees. 4.4 Refund Policy: Subscription fees are non-refundable except as required by applicable Indonesian consumer protection laws (Law No. 8 of 1999 on Consumer Protection). If you are unsatisfied with a purchase, you may contact our support team within 7 (seven) days of purchase for a review. 4.5 Price Changes: We reserve the right to modify pricing at any time. Existing subscribers will be notified at least 30 days before any price change takes effect on their next billing cycle.

5.1 User Content: You may submit reviews, comments, and other content ("User Content") on the Platform. You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display it in connection with the Platform. 5.2 Prohibited Conduct: You agree not to: (a) Share your account credentials with others or allow multiple users to access a single account; (b) Copy, redistribute, or commercially exploit any Platform Content without authorization; (c) Reverse engineer, decompile, or attempt to extract the source code of the Platform; (d) Use the Platform to transmit harmful, offensive, defamatory, or illegal content; (e) Manipulate or game Platform features, including leaderboards, reviews, or referral systems; (f) Use automated tools, bots, or scripts to access the Platform; (g) Interfere with or disrupt the integrity or performance of the Platform; (h) Violate any applicable laws or regulations of the Republic of Indonesia.

6.1 Platform Content: All Content on the Platform, including courses, videos, graphics, logos, and software, is owned by or licensed to PT Eterna Edukasi Nusantara and is protected under Indonesian copyright law (Law No. 28 of 2014 on Copyright) and international intellectual property treaties. 6.2 Instructor Content: Instructors retain ownership of their original course materials. By publishing on the Platform, Instructors grant PT Eterna Edukasi Nusantara a non-exclusive, worldwide license to host, distribute, and display their content on the Platform. 6.3 Certificates: Certificates issued by the Platform are the property of PT Eterna Edukasi Nusantara. They are issued for personal and professional use and may not be altered, forged, or misrepresented. 6.4 Trademarks: "Eterna Academy", the Eterna logo, and related marks are trademarks of PT Eterna Edukasi Nusantara. You may not use our trademarks without prior written consent.

7.1 Certificates are issued upon successful completion of course requirements as determined by the Platform and/or Instructor. 7.2 Certificates represent completion of a specific course on the Eterna Academy platform. They do not constitute academic degrees, professional licenses, or government-recognized certifications unless explicitly stated. 7.3 Certificate pricing varies by subscription tier. PT Eterna Edukasi Nusantara reserves the right to modify certificate pricing and issuance requirements. 7.4 All issued certificates can be verified through the Platform's certificate verification system.

8.1 Instructors must submit an application and be approved by PT Eterna Edukasi Nusantara before publishing content on the Platform. 8.2 Instructors are responsible for the accuracy, quality, and legality of their content. Content must not infringe upon the intellectual property rights of any third party. 8.3 Instructor commissions are calculated according to the Eterna Academy Profit Share model as detailed in the Instructor Agreement. Commissions are paid monthly, subject to applicable Indonesian tax withholding requirements. 8.4 PT Eterna Edukasi Nusantara reserves the right to remove or modify any Instructor content that violates these Terms, applicable laws, or our content quality standards.

9.1 The Platform may host virtual events including webinars, workshops, live Q&A sessions, and masterclasses. 9.2 Event access and pricing may vary based on your subscription tier. Tier-specific access details are provided on the event listing. 9.3 Event registrations are subject to availability. Waitlist positions are managed automatically. 9.4 Cancellation of paid events is subject to the refund policies outlined in Section 4.4.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: (a) The Platform will be uninterrupted, timely, secure, or error-free; (b) The results obtained from the Platform will be accurate or reliable; (c) Any errors in the Platform will be corrected. To the extent permitted by Indonesian law (including Government Regulation No. 71 of 2019 on Electronic Systems and Transactions), we disclaim liability for any losses arising from the use of the Platform.

To the maximum extent permitted by applicable law, PT Eterna Edukasi Nusantara, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of or inability to use the Platform. Our total aggregate liability for any claims arising from or relating to these Terms or the Platform shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim. Nothing in these Terms shall limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under Indonesian law.

You agree to indemnify, defend, and hold harmless PT Eterna Edukasi Nusantara and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) Your use of the Platform; (b) Your violation of these Terms; (c) Your violation of any rights of a third party; (d) Any User Content you submit to the Platform.

13.1 You may terminate your account at any time by contacting our support team or through your account settings. 13.2 We may suspend or terminate your account at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms. 13.3 Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

14.1 These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. 14.2 Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation between the parties for a period of 30 (thirty) days. 14.3 If the dispute cannot be resolved through negotiation, it shall be submitted to the Indonesian National Arbitration Board (Badan Arbitrase Nasional Indonesia / BANI) in Jakarta, in accordance with BANI Rules then in effect. 14.4 The language of the arbitration proceedings shall be Bahasa Indonesia, unless both parties agree to use English. 14.5 Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction in Jakarta.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least 30 (thirty) days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

16.1 Entire Agreement: These Terms, together with our Privacy Policy and any applicable Instructor Agreement, constitute the entire agreement between you and PT Eterna Edukasi Nusantara regarding the Platform. 16.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. 16.3 Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. 16.4 Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction. 16.5 Language: These Terms are available in Bahasa Indonesia and English. In the event of any inconsistency, the Bahasa Indonesia version shall prevail for Users domiciled in Indonesia.
